Should I Hire an Employee or a Contractor?


Are you confused about whether you should hire a contractor vs employee? If so, you’re not alone. Knowing when it’s time to hire a contractor instead of an employee is one of the most confusing aspects of employment for many businesses. Below we have provided some tips to help you sort through the confusion regarding independent contractor vs. employee hiring.

One of the most critical aspects of understanding contractor vs. employee hire is in understanding each are classified. If you should incorrectly classify someone as either one or the other, you could held liable for employment taxes as well as a penalty by the IRS.

The basic rule of thumb to remember when trying to determine whether someone is a contractor or not is by asking yourself whether you have the right to control or direct result of the work or the means and methods of accomplishing the result. If you only have the right to control the results of the work, then the individual is a contractor. However, if you have the right to control the means and methods by which the work is accomplished, then the person is an employee.

If you keep the rule regarding what you have the right to control and direct in mind, it will help you to remember the difference between employee and contractor hire. Knowing when and how to hire a contractor; however, requires understanding the various advantages and disadvantages of each classification.

One of the biggest myths regarding contractor vs. employee hire is that you won’t be required to deal with reporting income on contractors. This is only partially true. You are still responsible for reporting wages that you pay to an independent contractor if you pay that person more than $600 per year. This information is reported on IRS Form 1099-MISC, Miscellaneous Income.

When you make the decision to hire an independent contractor, it is always a good idea for both of you to sign an agreement putting forth the terms of your business relationship. This agreement should include the services which are to be performed, the timing regarding when the services are to be performed, specific information on the payment for the services, confidentiality, warranty and work for hire information.

If you are not familiar with the terms work for hire or you aren’t sure about what kind of confidentiality information you should include in an independent contractor agreement, take a look at these tips.

Generally, most independent contractor agreements include information that states the contractor is not allowed to use any proprietary information they learn about your company during the course of working for you that could be used for any other purpose than the benefit of your business.

It’s very important that you include a work for hire statement in your agreement. This stipulates that the work or product which is developed will be liable to copyright laws and as such will be owned by your company; not the contractor.

Knowing when to hire an independent contractor and how to hire an independent contractor vs. an employee can be confusing. Understanding the differences between the two as well as the various advantages and disadvantages can help you to sort through the confusion.

Personal Finances for Business Start Up


Discover the personal preparations required before starting a business. Learn about the gray line between personal information and business information for a small business owner.

Many business owners agree that starting a small business will involve the personal finances of the owner, even though the business may be formally regarded as separate entities. This is probably due to the fact that the business owner may be likely to lose his source of income during the initial operations period, especially during the first 3 to 6 months. With this, adequate planning, budgeting and saving should be done by the business owner prior to starting the business so as to have a pool of funds to support personal expenses.

One of the first steps to do this would be to track your monthly expenses on a daily basis in order to adequately determine your actual personal costs. Be sure to include buffers for emergency or surprise expenses. Once you have a clear idea where your monthly expenses go to, you can then create a budget for the period that your income may be affected. It may also be a good idea to pay off any outstanding debt such as home loans or car loans, so that you have less to pay for during the critical period.

It is of utmost importance that you ensure that you have enough to sustain you, as many new business owners overlook this factor, and end up going back to employment while still maintaining their business after a few months, due to the lack of personal funds.

Apart from that, if you are starting a business for the first time and are in need of obtaining a business loan, the bank or credit union will evaluate your application based on your personal credit rating. This is due to the fact the company’s credit history is not yet available for references by these financial institutions. Therefore, the best history that they can base their judgment on your creditworthiness would be the credit history of the business owner.

What is the implication of this? This means if you are planning to start a business and obtain financing for it, it is best for you to run a check on your credit report in the event of errors and flaws. There have been cases where loans were rejected due to an unfavorable credit report, which was actually due to errors made by the system. With this, months may be needed to correct these problems, which may cause delays for the business owner to obtain the required start-up funding for the new business.

In conclusion, the business is a separate entity when it is registered as a private limited company. However, small business owners still may not escape entirely from being regarded as separate entities if they are the only owners of the businesses that they are running. Therefore, business owners should be well-informed on the areas that would require more focus on before they start their businesses.

Tips on Making your Way through the Murky Waters of Obtaining a Business License

While there are many duties and tasks to fill your hours and days when starting a business, one of the most important tasks that should be handled early on is to obtain a business license or business permit. Unfortunately, many people overlook this necessity and end up getting in legal trouble because they failed to do what was necessary to obtain a small business license.

If you aren’t familiar with the process of how to obtain a business license, we’ll provide you with a few tips below. First; however, let’s take a look at why it’s important to take care of handling your business license permit.
Business permits and business licenses are required by most city, county and state governments. Depending on your situation, you may also be required to obtain a business license or business permit by the Federal government. A local business license, issued by the county or municipal government is a general license that gives you the right to operate a business within the jurisdiction of that county or city. The fees are not usually expensive. This is what you’ll need to do in order to complete a business license application.

First, you’ll need to make sure that you have all of your business paperwork in order. Make sure that you have your Employer Identification Number, also known as EIN. Next, contact your county government or city hall office to find out exactly what kind of business license you need and to obtain a copy of the business permit application. After you have completed the application and filed it along with the appropriate fee, you’ll need to make sure that you stay on top of filing your business permit renewals. They do not automatically renew. This usually must be handled annually.

State business licenses and business permits are required for the operation of business that provide services or products that are regulated by State law. In addition, if your business is required to meet codes or standards, you will most likely be required to obtain a business license. Below are some tips on how to get a business license on the State level.

The process for obtaining a State business license is quite similar to obtaining a local business license. You will need to contact the appropriate office to determine what kind of license you need. Your local government may be able to help you with this. For example, if you are looking to obtain a California business license or business permit, you may need to contact the State of California. Beyond this, the process is exactly the same. File the appropriate paperwork and fee; then make sure you file your renewals each year.

One thing to keep in mind regarding business permit and business license is that they are different. While a business license allows you to legally operate a business within a jurisdiction; a business permit regulates safety and structure. For example, you may be required to obtain a business permit to purchase wholesale merchandise for resale, to remodel or build on a commercial site, to legally prepare food in a restaurant or to operate a business out of your home. Each of these situations requires a different type of business permit. Other than this, the procedure for applying for a business permit is almost exactly the same as applying for a business license.

Summary: Failure to obtain the right business law and/or business permit can lead to all kinds of trouble. By following these simple and easy to understand tips, you can make sure you have the right business permit or business license to protect your business.
